EVENT AGREEMENT/RULES & REGULATIONS
 CASTLE GARDENS agrees to rent the following facilities to the undersigned CLIENT, subject to the following conditions: 
1.       CLIENT agrees to return the setup sheet and final payment within 30 days prior to their event.   If CASTLE GARDENS does not receive the final payment within this time period prior to your scheduled event date, we assume you are canceling your event. (see section 26 for cancellation terms)
2.       CLIENT agrees to pay the balance due 30 days prior to the event date. Monthly installment payments can also be made prior to the 30 days without interest charges.
3.       CLIENT has agreed to use the facility during the _______day of ___________________, 20_____ during the hours of __________ until ___________.  (6 Hours Total Use on the day of the event)  All Events MUST END on or before 10:00 pm according the Ada County Permit. NO EXCEPTIONS. Please instruct your party NOT to come earlier than your allocated date and time and must leave at the appropriate ending time. If you have added the Wedding Package to your reception, you will also receive 1 hour rehearsal on another day prior to the event date. This has been scheduled on _______day of __________________, 20_____ during the hour of ________ until ________ . If you exceed 1 hour rehearsal, an additional $100 will be charged. Make sure all of your bridal party arrive on time, as the rehearsal will begin on time with or without all of the bridal party present.
4.       CASTLE GARDENS is a private residence with a special use permit as a social hall/reception facility that can accommodate weddings, receptions, festivals & shows, corporate events, and other special events.  We confirm your exclusive use of the facilities during your allocated time. This DOES NOT include the use of our personal residence side of the Castle. This does include the use of the bridal room and a Grooms changing room upstairs. These rooms are for the use of the Bridal party ONLY. Your guests are NOT permitted to use these rooms. These changing rooms ARE NOT to be used for social rooms. ALCOHOL IS STRICTLY PROHIBITED in these rooms. NO Food or Beverage will be allowed upstairs in the bridal room or grooms changing room EXCEPT WATER. NO EXCEPTIONS! If you need to snack on items prior to the wedding or event, use the dining area downstairs. ABSOLUTELY NO SMOKING INSIDE THE BUILDING! Please make arrangements to have all dressing items removed from these rooms prior to 10:00 pm as these rooms will not be available for dressing after this time.
5.       CASTLE GARDENS agrees to provide electricity, water, trash cans, restroom paper products, and on site supervisors before, during and after the event. Your guests CANNOT use any of these provided items for car decorations. Any and all car decorations in the parking lot MUST be cleaned up immediately. If Castle Gardens has to clean the parking lot afterwards, another cleaning deposit of $100 will be charged to CLIENT.   
6.       Tables, chairs, linens, centerpieces, and background music, are available for use during the event; any additional items will be listed on the setup sheet binding to this contract.  Damages will be billed to CLIENT and CLIENT takes full responsibility for any damages of their guests. (including stolen pewterware)  Credit card information will be held on file until after the event for such damages and will be charged immediately for any damages and/or stolen pewterware. Pewter goblets and platters will be charged to the CLIENT at $20 per piece.
7.       CLIENT agrees that any alcohol will be serviced ONLY by a Licensed Traveling Bar with Castle Gardens included in their insurance.  At this time, Jo's Traveling Bar (208) 440-6429 has full insurance liability and also REDEYE Catering (208) 695-3765 for Castle Gardens. If you use another Licensed Traveling Bar, proof of insurance and liability release for Castle Gardens is required PRIOR TO THE EVENT DATE. No other alcohol beverages will be permitted on the grounds and CANNOT be brought in by CLIENT or CLIENTS GUESTS. Any alcohol that is brought in by guests or CLIENT will be confiscated by Castle Gardens. Alcohol will only be allowed in the back garden ONLY and NOT IN THE PARKING LOT. Last call for alcohol will be made 30 minutes to event ending time. We want your guests to enjoy themselves at your receiption and we have provided areas for them to drink and smoke. However, if alcohol is served, we will not allow drunk obnoxious behavior. You may want to have someone (ie. The Brides Father or Best Man etc…) contact our staff the day of the wedding so that we will have someone who might intervene before a guest is asked to leave the property. You will not be consulted about the decision to have that guest leave. CLIENT RELEASES CASTLE GARDENS, OWNERS AND EMPLOYEES FROM ANY AND ALL LIABILITY ASSOCIATED WITH ALCOHOL USE AT CASTLE GARDENS. 
8.       CLIENT agrees that they can use their own vendors for catering, photography, videography, floral, wedding cake, live music, DJ, transportation and miscellaneous unless otherwise specified. They MUST BE A LICENSED CATERER WITH THE STATE OF IDAHO. Any outside vendor will assume their own responsibility for setup and take down along with any additional electrical cords/tables/linens or set up needed for their specific service. Any outside catering will NOT be able to use pewterware for service. a. Photography is only allowed during your scheduled event time – they do not need to show up earlier than your scheduled time.b. Plant labels and tags may not be removed.  Do not rearrange or pick flowers and foliage. c. Photographers, subjects, and all equipment must remain out of garden beds at all times.  Do not hang clothing, backdrops, etc. on plants or trees.
9.       CASTLE GARDENS has contracted with a few venders at a discounted rate and pay them directly on CLIENT’s behalf. They are, however, independent contractors and if problems arise with their particular service, CLIENT must resolve that problem between themselves and each vender accordingly. CASTLE GARDENS will not be held responsible.
10.    WEDDING CAKES: CASTLE GARDENS packages include the Wedding Cake. CLIENT has the option to choose their own cake decorators and deduct $1.00/person/package. CASTLE GARDENS does not set up the cake and will NOT be held responsible for any damaged cakes.  If you do choose one of our recommended cake decorators, the package includes ONLY Buttercream or whipped frosting cake and the size is for the reception quantity that you have chosen. Any FONDANT cake icing or other services or increased cake size will have to be purchased directly with the cake decorator and the CLIENT. CASTLE GARDENS is NOT responsible for any cake problems that may arise.   We pay for the wedding cake at a discounted rate on your behalf, however you have chosen the decorator and should contact the Cake decorator directly if you have any complaints or problems with the Wedding Cake.   Any refunds or corrections will be made directly between CLIENT and CAKE DECORATOR.
11.    CASTLE GARDENS reserves the right to inspect and control all parties, meetings, receptions, etc.  CLIENT agrees to keep musical entertainment at a reasonable level throughout the course of the event.  CASTLE GARDENS reserves the right to monitor and require adjustment of sound levels. DJ Services and Music MUST end before 10pm with NO EXCEPTIONS. CASTLE GARDENS has contracted with the DJ and included in your reception package for a total of 4 hours, which includes 30 minutes for wedding time if you have added the wedding package to the reception. Any DJ service that is requested by CLIENT over this total hour usage of 4 hours, must be paid directly to the DJ at $100/hour additional fee. Any additional services that the DJ offers, is also paid direct to the DJ and will NOT be the responsibility of CASTLE GARDENS. If you cancel your event $200 paid to the DJ for Deposit in your behalf will be forfeited from your Deposit you have paid to CASTLE GARDENS.
12.    MINISTER SERVICES: Castle Gardens will provide a minister for your wedding package if you so choose, which is included in the wedding package rate. If you do not want our minister, deduct $100 from the wedding package rate. Any problems CLIENT has directly with the minister must be directed to the minister, as this service has been prearranged between the CLIENT and the MINISTER  directly for the wedding proceedings. Any refunds or complaints would be handled directly by the minister to CLIENT. If you cancel your event $100 paid to the Minister for Deposit in your behalf will be forfeited from your Deposit you have paid to CASTLE GARDENS.
13.    CATERING: Three item refreshments plus non alcoholic punch is included in the reception package and is provided to Castle Gardens by a licensed caterer. Any problems, dislikes or allergic reactions associated with the food is the responsibility and liability of the Idaho Licensed Caterer providing the refreshments. If CLIENT decides not to the include the refreshment menu, deduct $4/per person and the CLIENT may use their own caterer as long as they are an approved IDAHO STATE LICENSED CATERER and this must be preapproved by CASTLE GARDENS prior to the event. CASTLE GARDENS WILL NOT provide pewterware for any outside Caterers or serving personnel. Outside caterers MUST provide their own serviceware. All Caterers must be responsible for their own set up and take down, refrigerated services and heating services. They can have access to the serving kitchen but all foods must be prepared prior to the event. The serving kitchen does NOT have cooking facilities available.
14.    CASTLE GARDENS Personnel Responsibilities:  Only approved personnel are allowed access to lighting, electrical, and behind-the-scenes areas or in private residence.  Staff will be available prior to, during, and after the event to operate its facility and equipment safety and efficiency.
15.    Sufficient LIABILITY INSURANCE is in effect at CASTLE GARDENS to cover any and all claims from accidents or injuries caused by STRUCTURE FAILURES ONLY as long as the failure was not caused by CLIENT or CLIENTS GUESTS.  Any other accidents, regardless on the grounds, indoor facility or parking lots are NOT the responsibility of CASTLE GARDENS and CLIENT assumes that responsibility. CLIENT may wish to purchase a separate event liability package from their homeowner's insurance agent.  Children should NOT be allowed to climb on rocks near the waterfall or play in the water. The Gardens are NOT a babysitting area and all guests should monitor their children and keep them off of the Water Fall or other private garden areas. CASTLE GARDENS will NOT be responsible for any accidents and CLIENT will be billed for broken items/plants by their guests.
16.    Fire exits, aisles, and equipment cannot be blocked.  All decorations must be made of non-combustible materials and nothing will be allowed to be placed on the walls.  Any activities or decorations involving the use of open flame are prohibited with the exception of CASTLE GARDENS centerpieces, or items that are pre-approved by CASTLE GARDENS and must be in glass coverings.  DO NOT LET YOUR GUESTS SIT OR PLAY ON THE STAIRWAY.
17.    CLIENT agrees to give an estimated number of guests at time of initial booking.  The final attendance number (which is given to the caterer and CASTLE GARDENS) will be required on the final wrap up sheet 30 days prior to the event.
18.    CASTLE GARDENS does not allow rice thrown or fireworks. Grass seed or bubbles are allowed.  
19.    CLIENT will provide CASTLE GARDENS with a list of any outside vendors on the setup sheet.  CASTLE GARDENS will schedule setup times, delivery space, and confirm guest numbers with the caterer.
20.    Space is limited for deliveries and must be approved in advance; CLIENT agrees to schedule any other deliveries with CASTLE GARDENS.  All deliveries and pick-ups must be conducted in a manner that does not interfere with other CASTLE GARDENS events.  All deliveries must be made at the side of the building and not in the front drawbridge area.  DO NOT PARK ON DRIVEWAYS.
21.    PARKING is permitted in the front parking lot ONLY. Handicapped or elderly can be dropped off at the front drawbridge but cars cannot be left or parked in the driveway. Bridal party may be dropped off also in the front drawbridge area but cars cannot be parked and left in the driveway. 
22.    Use of all tape, pins, staples, nails, balloons, confetti, glitter, birdseed, flower petals, bubbles, etc., must be approved by CASTLE GARDENS prior to use.Real flower petals are only allowed outdoors. For indoor weddings, silk flower petals may be used ONLY but CANNOT be used outdoors. Rice is NOT permitted. 
23.    CLIENT agrees to hold harmless CASTLE GARDENS in the event of any theft or loss before, during, or after the event.
24.    CASTLE GARDENS will not be responsible if they cannot supply meeting or banquet facilities as a result of occurrences beyond the control of the facility (public emergency, act of God, weather etc.) If your event is larger than contracted with Castle Gardens, your party may be asked to exit to the outdoors as a limited number of guests are allowed at one time inside. Food/chairs/tables will be sufficient for the amount of guests you have contracted for only.
25.    As a benefit to the CLIENT, CASTLE GARDENS will provide the reception area coordinating with CLIENT ceremony rental for inclimate weather back-up.  However, CLIENT needs to be reminded that the reception area has a maximum capacity of 75 people. CLIENT agrees to make a "RAIN CALL TWO HOURS prior to ceremony start time.  In the event of a RAIN CALL the ceremony will be moved into the coordinating reception hall at no additional charge. If you do not call...Castle Gardens will make the determination to move your ceremony indoors to the reception area.  If there is a possibility of rain or very hot weather, CLIENT should prepare early by renting a tent for additional protection or shade.  CASTLE GARDENS is NOT responsible for tent rental.  
26.    The indoor reception area comes with a standard decoration package; please do not remove any decor from the areas or add anything to walls.
27.    Your vendors agree to abide by our etiquette rules and CLIENT will take full responsibility for all outside vendors.
28.    CLIENT agrees that the photographer may provide CASTLE GARDENS with select photos to use for advertising.  CLIENT authorizes and release to CASTLE GARDENS the use of my image in any photograph or video recording for any advertisement purpose of CASTLE GARDENS.
29.    Any special needs guests are the responsibility of the wedding party. If you do need special help, please contact   wedding coordinator  prior to the wedding to see if we can help accommodate any special needs.  Special Needs restroom is located outdoors along the ramp if needed.
 
 
If the wedding date is changed to another date, a $200.00 change fee will apply.  It is always sad when CLIENTS have to cancel their event, however all the vendors and Castle Gardens has turned down other events on your same date. If the event is canceled 6 months or more prior to the event, $300 cancellation fee will be forfeited from the 25% deposit for Castle Gardens, $200 cancellation fee will be forfeited deposit paid to the DJ, $100 cancellation fee will be forfeited paid to the Minister and $100 cancellation deposit paid to the Carriage Rental on CLIENT’s behalf. (This could result in a total $700 cancellation fees if you have met with the DJ, Minister and Carriage was reserved) The balance will be refunded to the bride _______ or groom _______ or other _______________________listed on this contract.
Other Cancellation charges are based on the current rental rates and the estimated guest count given at the time of booking; the cancellations are assessed as follows:
    1. 6 months to 90 days prior to scheduled event date, CLIENT forfeits the total nonrefundable 25% Deposit retainer.
    2. 60 days - 89 days prior to scheduled event date, CLIENT forfeits the 25% Deposit retainer, plus 25% of the total contract balance. 
    3. 30 days - 59 days prior to scheduled event date, CLIENT forfeits the total 25% Deposit retainer plus 50% of the total contract balance.
    4. Less than 30 days prior to scheduled event date, CLIENT forfeits the 25% Deposit  retainer plus 100% of the total balance.
    5. As of today, the total contract is $ ______________________ and the total deposit paid is $_____________________.
 
I have read, understand and agree to abide by Castle Gardens Facility Use Policies/Service Agreement. I understand that I assume all risks for loss, damage, liability, injury, cost or expense that may arise during, or be caused in any way by my use, my guests use or occupancy of Castle Gardens facility and property. I further agree to hold Castle Gardens and/or its owners, employees and representatives free and harmless from any loss, claims and liability, or damages and/or injuries to persons or property that in any way may occur as a result of my use or occupancy. As the undersigned, I hereby certify that I will be personally responsible for any damage or theft at Castle Gardens. My signature certifies that all information on this application is true. I understand and agree that any misstatement or omission of material fact herein may cause forfeiture of my wedding date and deposits.
   We have read the rental conditions for CASTLE GARDENS and agree to all of the terms and conditions of the above Agreement:
